1. Agreement to Terms

By accessing or using HyPurShot (the "Service"), operated by HyPurDrive LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

HyPurShot is a mobile and web platform designed for auto detailing professionals. The Service enables users to:

• Capture and manage photos and videos of detailing work
• Generate social media captions using AI-powered tools
• Post content directly to social media platforms, including TikTok
• Manage teams and collaborate across business operations
• Collect customer reviews via SMS messaging

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access or use of your account
• Ensuring that your account information remains current and accurate

You must be at least 18 years of age to create an account and use the Service.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Send unsolicited or unauthorized messages, including spam
• Upload or distribute malicious software, harmful content, or illegal material
• Impersonate any person or entity, or misrepresent your affiliation
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service or its systems
• Use the SMS review feature to send messages to individuals who have not consented to receive them

We reserve the right to suspend or terminate accounts that violate these terms.

5. Third-Party Integrations

The Service integrates with third-party platforms and services to deliver its features:

• TikTok: Content posting and account management via the TikTok API, subject to TikTok's Terms of Service and Community Guidelines
• Twilio: SMS messaging for customer review collection, subject to Twilio's Acceptable Use Policy and applicable messaging regulations
• OpenAI: AI-powered caption and content generation, subject to OpenAI's Usage Policies

Your use of these integrations is subject to the respective third-party terms and policies. We are not responsible for the practices, availability, or content of third-party services.

6. Subscription Plans and Billing

The Service offers the following subscription tiers:

• Starter: $19/month
• Pro: $39/month
• Agency: $79/month

Subscriptions are billed on a recurring monthly basis. By subscribing, you authorize us to charge your designated payment method at the beginning of each billing cycle. All fees are non-refundable except where required by law.

We reserve the right to modify pricing with 30 days' advance notice. Continued use of the Service after a pricing change constitutes acceptance of the new rates.

7. Intellectual Property

Your Content: You retain full ownership of all photos, videos, captions, and other content you create or upload through the Service. By using the Service, you grant us a limited, non-exclusive license to host, process, and display your content solely for the purpose of providing and improving the Service.

Our Service: The Service, including its design, features, code, and documentation, is the property of HyPurDrive LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, HyPurDrive LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

9. Termination

You may terminate your account at any time by contacting us or through the account settings in the Service. We may suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users.

Upon termination:

• Your right to access the Service will cease immediately
• We may delete your account data after a reasonable retention period
• Any outstanding fees remain payable
• Provisions that by their nature should survive termination will remain in effect

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
